    Understanding Federal Criminal Law - Information from Federal Criminal Attorney:

    The judicial process in  federal criminal law cases involves the United States government attorney and the grand jury. The government attorney represents the U.S. case in most court proceedings, including all criminal law prosecutions. Grand juries review evidence presented by the government attorney and decides whether there is enough evidence to bring charges against a defendant. After a defendant is arrested on federal criminal charges, the probation officer or court pretrial services office will act immediately and interview the defendant to start an investigation of the person’s criminal background. The result of this investigation will be used to assist a judge in deciding whether to dismiss charges and release  the defendant before trial and whether or not to impose conditions of release.

    At the initial court appearance, the judge will advise the defendant of the charges filed, and consider whether or not the defendant should be released or held in jail until trial. The judge also decides if there is probable cause that an offense or crime has been committed and the accused has committed it.

    If a defendant is unable to afford a federal criminal attorney, they are advised of their right to a court-appointed defense attorney and then the court will with either appoint a criminal defense federal lawyer (public defender) or a private lawyer who has agreed to handle such cases from the court. Either way, the criminal defense federal lawyer will be paid by the U.S. court funds.

If there is probable cause to bring federal criminal charges, the judge will decide whether to release a defendant to his or her own recognizance before trial, requiring the accused to obey certain restrictions, such as drug testing or home confinement. The judge sometimes will require the defendant to report to a pretrial services officer to make sure he or she shows up at court. At the arraignment (pre-trial hearing) the accused enters a plea to the criminal charges brought by the government attorney. In most cases(more than 90%) the defendant accept a guilty plea rather than going to trial. The plea deal or plea bargain is when a defendant pleads guilty (in some cases to a lesser charge)in return for the district attorney or prosecutor agreeing to recommend a more lenient sentence or to dropping some charges. If a defendant pleads guilty to federal charges, the judge has the option of sentencing the defendant at the time, but most of the time the judge will determine the sentence at a later court date. In most felony federal cases the judge will wait for the outcome of a pre-sentence report and investigation (conducted by the court probation office), before sentencing the accused. If the defendant pleads not guilty to charges, the judge will proceed to schedule a trial date.
